1.1. INTRODUCTION
1.2. These general terms and conditions (hereinafter referred to as the "Terms" or the "Terms") apply to your use of our Digital Services.

2.2. The purpose of our services is to inform, communicate and offer goods and services.

3. TERMS OF USE
3.1. By registering as a customer/user or by using the Services or making Purchases, you accept these Terms and Conditions, with the associated Privacy Policy. If you do not accept the Terms, you are not entitled to use the Services.
3.2. You may not make a Purchase or use the Services if: (a) you have not reached the age necessary to enter into a legally binding agreement and have not obtained the consent of a parent or other legal guardian, or (b) you are legally barred from using the Services under the laws of Norway or any other country.
3.3. When purchasing or signing up for the Service, you are required to register and we will tell you this clearly in the purchase process. We will tell you in advance whether we will charge you for the goods so that you can choose to make Purchases or subscribe to the Services. All references to subscription or the service in these Terms, including those in sections 5, 7 and 9, apply only to services for which you are registered.
3.4. Use of Services or Purchases from suppliers that are not Destination Trysil may require you to accept such suppliers' terms and conditions.
3.5. Destination Trysil reserves the right to change these Terms and Conditions at any time by posting a revised version on our digital platform. You acknowledge that you have read and understood (and agree to be bound by) these Terms now and each time you use the Services or make purchases.
3.6. An updated version of these Terms and Conditions is always available at Destination Trysil.
3.7. If any of these Terms and Conditions derogate from mandatory consumer law, the mandatory legislation shall prevail.
4. USER REGISTRATION
4.1. In order to make Purchases or use the Services, you may register. You can of course choose not to create a user, and you will still be able to use our services.
5. Specifically about purchases and orders
5.1 Some of the purchases and bookings you make via Destination Trysil may be subject to the Right of Withdrawal Act. For such purchases and orders, the conditions of the law apply. For purchases and orders from other suppliers, different terms and conditions may apply.
Please note that Destination Trysil will direct you to a number of 3rd parties that have their own terms and conditions. These are not Destination Trysil's responsibility.
5.2. When purchasing and ordering from Destination Trysil, you as a consumer may be entitled to withdraw from the purchase agreement in accordance with the provisions of the Right of Withdrawal Act. This means that under certain conditions, you have the right to cancel your purchase within 14 days from the date you received the item or received a receipt for your order for a service. According to the Right of Withdrawal Act, the following goods and services are exempt from the right of withdrawal:
a) Goods manufactured in accordance with your instructions;
b) Services initiated with your consent during the withdrawal period.
c) Events that take place at a certain time.
5.3. If you wish to cancel a purchase or an order, please contact us. Contact information can be found on your receipt. Remember that it is you who must prove that you have exercised the right of withdrawal within the withdrawal deadline.
5.4. Please note that via Destination Trysil you will be taken on to buy and sell with other parties. These are subject to the respective operator's terms and conditions.
6. PRICE AND PAYMENT
6.1. All our prices are inclusive of VAT at the rates applicable to the goods or services in question at any given time. Except in the event of obvious error, the prices payable for the Purchases you order will be the prices set on our service at the time you place your order.
6.2. Payment must be made using the payment solution of your choice, which you will find as part of our service. You confirm that the credit card/debit card or bank account used is your own, or that you have authorization from the cardholder to use it. All account holders and credit/debit card holders will undergo validity checks and subject to approval by the card issuer.
6.3. We reserve the right to refuse payment by credit/debit card at our sole reasonable discretion. We will process your payment in a secure manner.
7. TERM AND TERMINATION
7.1. You may enquire about the Services by email, see section 14. Cancellation of services in the form of subscriptions must be made at least 10 business days before the end of the month or year (depending on whether you pay monthly or on an annual basis) for which you have paid.
7.2. You may cancel your "Free Trial" (where no payment has been made and you are able to access the Services) at any time prior to the end of the relevant Free Trial and your credit/debit card will not be charged. The exact length of the Free Trial will be stated at the time of purchase. However, we will not issue a refund if you request cancellation or a refund after your Free Trial has ended and/or your credit/debit card has been charged for the relevant month, year or period.
7.3. We may terminate this Agreement with immediate effect and with written notice at any time if you are guilty of a material breach of this Agreement (any breach of clauses 3 or 10 will be considered a material breach), provide incorrect information upon registration or if you do not meet one or more of the technical requirements for the use of the Services.
7.4. In addition, we may terminate this Agreement upon one calendar month's notice. If we terminate the agreement on terms other than as a result of your breach of contract or non-technical compliance, you will receive a refund of the amount you have prepaid for the Services less a prorated amount for the number of days you have accessed the Services.
8. TECHNICAL REQUIREMENTS
8.1. You are responsible for ensuring that you have and retain all the hardware and software necessary to access, receive and view the Services or make Purchases.
8.2. In the event that we reasonably determine that you do not satisfy these requirements, we reserve the right to refuse to deliver to you, in which case you will be entitled to a refund of any amounts paid in accordance with clause 6.
8.3. We will use reasonable endeavours to ensure that the Services are made available to you at all times. However, the services are provided "as is".
8.4. From time to time, we will need to close and suspend the Services in order to carry out upgrades or maintenance. We will try to keep this to a minimum. Subject to the limitations set out above, we will perform the Services with reasonable quality. Other than this, we make no warranties (and exclude any warranty liability and any obligation otherwise implied, to the extent such disclaimer is permitted by law). This is without prejudice to any statutory rights you may have as a consumer.
9. TECHNICAL SUPPORT AND CONTACT WITH US
9.1. You may contact us whether you would like to discuss technical issues or have information about your Purchases or Services In any case, please provide your email address, product details, last transaction ID, postcode or any other data that we may require from you in order to assist you or identify your Service or purchase.
9.2. Any notice given by us may be given by postal mail or e-mail to the most recent postal or e-mail address we have on record for you. Failure to transmit or mail is at your risk and we will not be responsible for any failure to receive notices we send to you.
10. YOUR USE OF THE SERVICES
10.1. We are the owner or copyright holder of all intellectual property rights in the Services and in the material published through their use. This includes design, text, graphics, film clips, images and other creations you may receive. Any selection or arrangement of such material and creations is subject to intellectual property rights, including copyright, of us and/or others. You agree that you will:
a) use the Services solely for non-commercial purposes without making a profit from the use and that you will not allow any other person to use the Services. This means, for example, that you do not have to charge a fee to view the Services and that you cannot use the Services to entice others to buy goods or services from you or anyone else;
b) not copy, record or store all or any part of the Services (other than on a purely temporary basis to enable them to be viewed) or redirect, forward or otherwise distribute all or any part of the Services to any person, or authorise, enable or influence any other person to do any of the above;
c) not modify, disassemble, decompile or reverse engineer any part of the Services. In addition to our right to terminate the Agreement due to your breach of contract, we may suspend the Services (or your access to them) if your use of them is unlawful, unreasonable or contrary to the interests of other subscribers, or constitutes a breach of these Terms, or if we are requested to do so by a government agency.
d) not attempt to access the Services or Content through any technology or means other than through the websites or other features specifically designated by Destination Trysil for this purpose.
e) not circumvent, disable, or otherwise interfere with (i) security-related features of the Services, (ii) features that prevent or restrict use or copying of content, or (iii) features that limit the use of the Services or the materials available through the Services;
f) not use or initiate a robot, spider or other automated system that sends messages to Destination Trysil's servers;
g) not collect or store personal data or otherwise act in breach of the Privacy Policy;
h) not, without the consent of the copyright holder, copy, reproduce, distribute, transmit, display, sell, license or otherwise exploit any content or material of any person other than those specified in these Terms.
10.2. The Services must only be used for the purpose and in the manner for which they are intended. You are responsible for ensuring that your use does not cause damage or other inconvenience to Destination Trysil or third parties (e.g. mass calls or computer viruses) or violate any law or decision. Use in violation of these terms and conditions may be reported by Destination Trysil to governmental bodies, associations or regulatory bodies.
10.3. The Services and Websites are offered in any existing state. Destination Trysil cannot guarantee that the Services and services will always function without interruptions or are free from errors and omissions. Destination Trysil also does not guarantee that the information you receive when using the service is correct or reliable.
11. NOTICE POSTING AND USE OF CONTENT
11.1. You must use the sharing facilities responsibly and are solely responsible for any content you share/transmit.
11.2. Failure to comply with this Digital Platform Terms of Use constitutes a material breach of our Digital Platform Terms of Use, which is a prerequisite for your access to use our Digital Platform, and a breach of the Code may result in immediate, temporary or permanent withdrawal of your right to use our Services.
12. PRIVACY
12.1. Destination Trysil is the data processor for the personal data you provide when using our service. More information about this can be found in the privacy policy. We would like to point out here that our Services contain many links to 3rd parties. When you access these links, these rules for processing personal data apply.
12.2. By accepting these Terms and Conditions, you agree that Destination Trysil may, within its framework and purposes, use, modify, reproduce, develop, publish, produce, produce, distribute, transmit and market your user data, alone or together with other material. This right includes the right, within the scope and purposes of the Service, to use your user data in and for advertising, marketing, market research, quality control and other similar purposes. 15. FORCE MAJEURE
15.1. Destination Trysil has no liability to you for any delay or non-delivery of Services to the extent that such delay or non-delivery arises as a result of circumstances beyond Destination Trysil's reasonable control, including, but not limited to, failure of electronic or mechanical equipment or communication lines, third party action (including denial-of-service attacks and overuse or misuse of the Services), telephone or other connection problems, computer viruses, unauthorized access, theft, operator error, fire, severe weather conditions, floods, natural disasters, acts or decisions of regulatory, government or supranational authority, war, insurrection, strikes, lockouts, labor disputes, and cancellation or postponement.
16. GOVERNING LAW
16.1. These Terms shall be exclusively governed by and construed in accordance with the laws of Norway and you irrevocably submit to the jurisdiction of the Norwegian courts.
